Competition Specific Terms and Conditions
These Competition terms and conditions should be read together with, and are in addition to, Bauer Radio Limited’s standard terms and conditions at: http://www.bauerlegal.co.uk/radio-competition-terms.html (the “General Terms”). Together these specific competition terms and conditions and the General Terms shall be referred to as the “Terms”. Where there is a conflict between these terms and the General Terms, these terms shall prevail.
ITEM 1: COMPETITION NAME
“12 Daves of Christmas” running from Tuesday 4th December to Friday 21st December as set out below (the “Competition”).

ITEM 4: COMPETITION START DATE AND FINISHING DATE
Start Date: Tuesday 4th December
End Date: Friday 21st December
Entries to the competition will open on Tuesday 4th December at 6:00am.
The first round of the competition will take place on Thursday 6th December.
Shortly after 9am on Planet Rock, the presenter will reveal the name of that day’s famous Dave, as well as that day’s cash prize amount (“Prize Amount”). The name of the Dave and Prize Amount will be valid for the next round only (“Competition Round”) and the Prize Amount be the cash prize that entrants are trying to win (hereby known as “the Prize”). We reserve the right to announce the Dave and Prize Amount at other times each day, including the conclusion of previous rounds. We may also advertise the current prize amount on offer at the station website, social media or via SMS marketing message.
At 5:00pm each weekday (Monday to Friday) entry to the competition will be frozen and the presenter will randomly select (from all registered entrants) a chosen number to call. Competition Rounds will take place each weekday (Monday to Friday) between 5:00pm & 6:00pm.
To be eligible to win, the registered entrant must answer within 5 rings according to the station’s audio recording (“ring ring” being one ring and not two). The entrant will be asked to play the Competition as soon as they answer the phone. If they are not in a position to play for any reason (e.g. not answering phone, driving, or in a meeting) then they will not be able to play and no other entrant will be called during that particular Competition Round.
If the entrant answers their phone in time, they will be asked to name that day’s Dave. If they give the correct answer then they win the Prize. If the entrant gives an incorrect answer they will not win any prize.
The presenter will take the first answer given by the entrant as the one and only answer.
The final draw will take place on Friday 21st December at 5:00pm. If a winner is not declared at that time, the competition will continue that day as necessary, further callers will be chosen by random draw, until somebody wins and the prize money is extinguished. The final winner will be announced as soon as possible after they win; for the avoidance of doubt, this may take place any time on or before Monday 24th December.
Entry Periods and Round times
Entry to each round will be open as follows:
Round 1 will take place between 5:00pm & 6:00pm on Thursday 6th December. Entry to this round will be open between 6:00am on Tuesday 4th December and 5:00pm on Thursday 6th December.
Subsequent rounds will be between 5:00pm & 6:00pm each weekday. Entry to these rounds will open at 5:00pm the previous weekday and close at 5:00pm on the weekday of the draw. (For clarity, entries received on Saturday and Sunday will be entered in to the round between 5:00pm & 6:00pm Monday)
ITEM 5: ENTRANT RESTRICTIONS
Once you have entered this competition, you will be eligible for every subsequent round of the competition.
You can enter each round a maximum of 3 times per mobile number (including free entries) via SMS and a maximum of 3 times online for each round.
Entrants must obtain permission from the bill payer before texting to enter the Competition.
The Competition is only open to people aged 18 and over who: (i) live in the UK and (ii) are not one of our employees (or living with, or related to, one of our employees).
Entrants are only able to win a single prize throughout the duration of this competition. There is no limit on the value of a single prize that may be provided to the individual winner of a Competition. However, no person may win more than one prize valued at £500 or more via any of our Competitions in any six (6) month period. A winner may continue to receive SMS messages in relation to the Competition and invitations to enter the Competition. For the avoidance of doubt, a winner should not enter the Competition again if they have already won in the previous six (6) months as they are ineligible to win. If a previous winner is drawn at random in a subsequent competition, or subsequent round of the same competition, they will be disqualified, and another entrant will be drawn at random. If it emerges after a winner has been awarded a prize that they are a previous winner, in breach of these terms and conditions, they will be excluded and the prize shall not be paid to them. If the prize has already been paid, this must be returned immediately upon request. For clarity, it is possible to be drawn more than once, and if the entrant drawn has not previously won a prize, they are eligible to play and to win a prize.
In addition to previous winners, family relations of, or those living at the same residential address as, previous winners of this contest are ineligible to enter.
ITEM 6: ROUTES OF ENTRY AND COSTS
You can enter the competition by sending an SMS message starting with the keyword DAVE to 64100. If your message does not start with the valid keyword, or is not sent to the valid number, it will not be entered in to the draw. You will receive an automated SMS response to your SMS message confirming your entry. You can also enter for free here.
You are responsible for all costs associated with entering this competition. Texts cost £2.00 (from the UK) + standard network rate. You must have permission from the bill payer before sending. Online entry is free.
Once you’ve sent an entry text, you’ll receive an auto-response confirming your entry. You will then have the chance to text: DAVE to 64100, again (at a further cost of £2.00 + standard network rate) and you will be entered 2 more times – your ‘3rd’ entry being free.
ITEM 7: DRAW DETAILS
Entries will close at the end of each contest round, all valid entries will be pooled, and one entry will be selected by automated random draw.
The presenter will call the number selected (please note this could be from a withheld number). The entrant must answer the phone within 5 rings according to the station’s audio recording, and state the correct Dave when asked.
The entrant will not win the prize if they:
• fail to answer the phone at all; or
• fail to answer the phone within 5 rings (according to the station’s audio); or
• fail to state the correct Dave when asked;
Where any foul or explicit language is used, we reserve the right to disqualify you and any prize awarded will be forfeited.
The answer given must be clearly audible to presenters and adjudicators and audible on the studio’s audio recording. If this is unclear or inaudible due to a poor signal or any other reason, the presenter will ask the entrant to repeat their answer.
If entrants appear in the judgement of the presenters and/or adjudicators to be driving illegally, they will not be eligible to win. Where there is any doubt in relation to whether or not an entrant has spoken the correct Dave or the prize should be awarded, we reserve the right to defer decision making to an off-air adjudicator to check the audio recording with reference to these terms and conditions. All our decisions relating to the Competition and/or awarding of prizes are final. No discussions or correspondence with entrants or any other person will be entered into.
As set out above, following the conclusion of a round, a new round will commence in line with these terms and conditions. For clarity, a new Dave and Prize Amount will be announced for the next round. Anyone who entered any of the previous rounds, plus anyone entering the current round, will be eligible to win.
The final round will take place on Friday 21st December between 5:00pm & 6:00pm. If a winner is not declared, the Competition continues throughout the day until a winner is selected.
After lines are closed, we may record an entrant’s call off-air to be played out at a later time on-air. All callers are still randomly selected in the same way and this will only ever take place after the entries have closed.
ITEM 8: WINNER ANNOUNCEMENT
Entrants who are randomly selected to play will be contacted personally between 5:00pm & 6:00pm on the relevant day of the round. By entering the competition, you are automatically consenting to being called live on air at this time (where a call is not recorded off-air) and having your name and location announced on-air.
The name and the hometown of the winner may also be posted on the Promoter’s website and / or social media platforms after they have been announced on-air.
ITEM 9: PRIZE DETAILS
The prize will always be a cash amount that will be delivered to a winner paid in cash, by bank transfer or by cheque. The prize amount will have been specified on-air each time there is on-air communication about Competition entry.
Delivery of prize money is subject always to the winner providing photo ID and proof of address. Our prizes are always non-transferable and (unless the competition is for a cash prize) cannot be exchanged for cash. Payment can take up to 28 days.
Where, it emerges after a prize has been awarded that the entrant was in breach of these terms and conditions we reserve the right to declare the prize as forfeit.
ITEM 10: DATA PROTECTION
ITEM 11: INTELLECTUAL PROPERTY AND CONSENT
We will sometimes (at our discretion) telephone entrants and ask them to speak on-air. You have the right to refuse. If you consent, your voice will be recorded and you consent to this recording being used on our radio broadcasts. You agree that we will own this recording and that a copy of it will be stored for further exploitation, which may include promotion. You will not be put through to speak on-air if we think you are driving, intoxicated, likely to swear, or otherwise offend our listeners. Whilst on air for the purposes of this competition you must not use foul language, swear, say or do anything defamatory or illegal or say or do anything which would damage the reputation of Bauer, is offensive or inappropriate or which would cause us, or our listeners, harm . Failure to comply will result in disqualification, and if you have won the prize, this will be forfeited.
ITEM 12: OTHER CONDITIONS
We will only accept entries that comply with our terms and conditions and we may disqualify you if we know or suspect that you have breached them. Our decision on the selection of the winner is final and we won’t engage in any correspondence or discussion about this or about the operation of this competition. We are not responsible for any network or technical issues you experience, such as latency of your mobile phone network, which may delay or prevent your participation or cause you to lose the competition if on-air. We have the right to cancel, amend, terminate or suspend this competition if forced to do so due to circumstances outside our control.
